Expunctions
An expunction, governed by Texas Code of Criminal Procedure, Chapter 55, is the legal process for removal and destruction of an arrest and court records. Eligibility for an expunction is not automatic and depends on the circumstances of your arrest and case.
Below is a list of local agencies normally involved in the expunction process. This list is not all-inclusive, and you should include any additional outside agency that has published your information concerning the arrest/charge in your petition.
Please include the physical/mailing address along with the email address of each agency in your petition. If an email address is provided for an agency listed in your petition, there is NO “Issue expunction-electronic delivery” fee required. However, for each agency you include, which DOES NOT have an email address, you are required to pay the $25.00 “Issue expunction-confirm delivery” fee (which includes mailing of the notice and petition).
